John Eastman: Prosecutors get a search warrant on the lawyer’s cell phone

Investigators confiscated Eastman’s phone earlier this month in New Mexico after receiving a warrant to take the device. The agents needed a second warrant to search the contents of the phone, which they received on July 12.

The memo includes a so-called liquidation protocol, according to court records, to ensure investigators do not mistakenly obtain privileged information from the Eastman machine.

The memo is a critical step in the Justice Department’s intense investigation on January 6, 2021, as investigators focused on efforts by Trump and his close allies to nullify the 2020 election.

Eastman was one of the key individuals involved in pushing then-Vice President Mike Pence’s plan to cancel the January 6 2020 election by rejecting voters from some swing states. Two of Pence’s aides recently testified under subpoenas to a federal grand jury about the role Eastman and others played in the lead up to Jan. 6.

Eastman had previously asked a New Mexico judge to deny management access to the contents of his phone, alleging that customers “forced” him to unlock his phone.

The judge denied the request, saying that investigators followed appropriate protocols to obtain the device, and that his communications were not protected under the First Amendment.
